According to the provision of Section 197 in the Income Tax Act 1961, facilities of giving low tax or zero deduction of TDS (which is known as TDS exemption). The balance between the requirement of cash by the taxpayer and realizing the Government dues is the main provision of this section.

Meaning of TDS?

TDS - Tax Deducted At Source

The abbreviation of Tax Deducted At Source is TDS. According to the income tax act, after a certain threshold limit income, a minimum percentage prescribed by the government which will be deducted as tax from the income such as salaries, fees, commission, rent, etc.

A company or an individual who makes payment of the deductible amount as tax to the government is called ‘Deductor, on the other hand, receiving an end of the payment is called ‘Deductee’. Payment of tax can be in any mode, be it cash, cheque, or card.

Two sections of the Income Tax Act provide the ways to lower tax rate deduction exemption or even facility to file NIL. In any case at the time of filing return, the taxpayer thinks that the tax liability is significantly or considerably less than that of paid, then he/she claim the refund for the same amount. However, section 197 and 197A provides to file no TDS in any case taxpayer thinks his tax liability for a year is zero or nil.

For file at a low rate or nil filing, the taxpayer needs to submit an application along with form 13 to the Assessing officer of the income tax department. The taxpayer can claim a refund in their annual return in case he/she does not apply for a certificate.

Where One Can Avail No TDS

  • Selling of immovable property by a non-resident.
  • If a business is running in loss.
  • If the profit of a business is not up to taxable purview.
  • Deduction of profit u/s.10 eligibility.
  • Weighted deduction of expenditure eligibility.

Circumstances for a Lower TDS Allowed

Section 197 empowers the assessing officer to grant a certificate provided he is satisfied that the deduction of tax at a lower rate or no deduction should be made.

To concluding for such satisfaction a mechanism is provided under the rule 28AA of the income tax act 1962.

According to the rule 28AA, the officer assessing tax should be satisfied that tax liability of person whether existing or estimated tax is appropriately deducted at a lower rate or nil tax after deduction.  Sub-rule 2 of the rule 28AA depicts the parameters and conditions for the assessing officer for determining the deduction.

How to Move to No TDS or Lower TDS?

Certain procedures are needed to be followed by Assessee they are:-

  • The deducted tax is at source under sections 192, 193,194, 194A, 194C, 194D, 194G, 194H, 194I, 194J, 194LA, 195.however assessing officer should be satisfied for no or lower tax deduction of TDS.
  • Submission of an application with form 13 for considering permission for no TDS or lower TDS.
  • Within 30days that application should be entertained and disposed of by the assessing officer.
  • At first instance, it is advisable to the taxpayers to file correct information. After being satisfied by the assessing office then he shall conclude by issuing a certificate under section 197.
  • After that one copy of that certificate attached along with the invoice raised for a lower tax deduction. That certificate is valid as long as AO cancels it. Under sections 194B, 194BB, 194DA, 194E, 194IA nil deduction or lower tax rate are not applicable.
  • The Deductor must have to validate the PAN details, current fiscal year and certificate number after receiving the certificate. Two flags ‘A’ and ‘B’ raised for a statement of certificate u/s 197 and certificate u/s 197A respectively.

It is a predefined format under which an application for lower or no TDS u/s 197 is made by a taxpayer. Following information are:

  • PAN and Name of applicant.
  • Refund purpose.
  • Certificate number.
  • Details of income for the last three years.
  • Current fiscal income.
  • Last three year of tax paid.
  • Current fiscal tax to be paid

India to Build an IMEI Database for Lost or Stolen Smartphones!

  • As reported in The Indian Express,  the Department of Telecom (DoT) is readying a one-of-its-kind ‘Central Equipment Identity Register’ (CEIR).
  • For those who don’t know what IMEI number is, it is a unique 15-digit number which is used to identify each and every phone. (To find the IMEI no. of your phone, open the dial pad and press *#06#  works only on Android)
  • The idea for the IMEI database was proposed back in 2012 and it got approval in 2017.
  • The Telecom Ministry tested the database in Mumbai and its success there has now prompted for it to be made accessible nationwide.

”The primary objective of the CEIR is to help reduce mobile theft in India by a significant margin.”

  • Wondering how the database will work? Here’s it. A person who has lost his phone will have to first of all lodge a report with the police. After that, you can call a dedicated helpline and inform the DoT (Department of Telecom) about the loss/theft. The DoT will then blacklist the smartphone making it useless as it won’t be able to access cellular networks in the country.
  • Along with that, the database will be divided into three parts – white, grey and black. Smartphone labelled as white are those that aren’t lost or stolen. While the smartphone labelled as grey and black, will the ones that are lost or stolen respectively.

In a tweet, on 21st of this month, Xiaomi India’s MD Manu Kumar Jain announced that Xiaomi India is about to turn 5. He added that the first phone they launched was the Mi 3 in July 2019. With the first sale on 22nd July.

Manu also announced that they’ll be celebrating this anniversary with 5 weeks of celebrations.  Where every week they’ll be they will have new surprises, offers and product launches. Some product launches that will take place in these 5 weeks are of the Redmi K20 Pro (confirmed), Mi Band 4 (expected), and Mi Trimmer (as it has been teased in a few tweets from @XiaomiIndia).

After releasing the Mi Band 4 in China, Xiaomi has launched it in the international markets. The device will be coming to India most probably in the upcoming 5 weeks. The most apparent upgrade in the Mi Band 4 from its previous band is the display.

The new band has a 0.85” colour AMOLED display without the physical button. The band has an upgraded 130 mAh battery. The thing that’s disappointing is that it won’t come with any AI assistant onboard. although it is worth noting that the band’s Chinese variant has Xiao AI which is Xiaomi’s AI assistant.

It is available for almost all the major Linux distributions. Apache Cassandra can efficiently support and boost the capability of the applications that require the processing of a lot of data. It has a powerful resource manager that can effectively perform all the tedious tasks.

The next version of the Apache Cassandra, i.e., 0.7, it was released on January 08, 2011. In this edition, it was allowed to change online schemas, and secondary indexes were added. In the next update, i.e., 0.8, the functionality of Cassandra Query Language (CQL) and support for zero-downtime upgrades and self-tuning tables were introduced.

Version 1.0 contains the improved read-performance, integrated compression, and levelled compaction. Version 1.1 was released on Apr 23, 2012. It includes row-level isolation and self-tuning caches. Version 1.2 was released on Jan 2, 2013, and provides request tracing, inter-node communication, and atomic batches.

Version 2.0 was released on September 4, 2013. It contains improved compactions, lightweight transactions, and triggers. In the successive releases, i.e., 2.1, 2.2, and 3.0, there were no significant changes made in them.

The odd numbered releases from 3.1 to 3.10, i.e., 3.1, 3.3, 3.5, 3.7 and 3.9 contained only bug fixes while the even numbered versions, i.e., 3.2, 3.4, 3.6, 3.8 and 3.10 contained both bug fixes and new functionalities and features. All these releases from 3.1 to 3.10 were monthly updates.

The latest addition in the Apache Cassandra is of the version 3.11 on February 11, 2019. Release 3.11 was equipped with critical bug fixes and the addition of new features in it.

You can either install the Cassandra from its.DEB file or add the official package repository of the Cassandra and make the installation and updating process of the Apache Cassandra a lot easier.

Adding the Official package repository

To install the Apache Cassandra easily, you can add the official repository of the Cassandra by entering the following commands into the terminal:

wget –q -0 – https://www.apache.org/dist/cassandra/KEYS | sudo apt -key add –

Right to Privacy comes under Article 21 of the Constitution of India, which talks about Right to Life and Liberty. What privacy are we talking about here? This right to privacy ensures that if a person wants to remain silent about identity, they must have a right to do so, under certain restrictions. This question of the right to privacy arose when a person tried to challenge the validity of Aadhar Card, Unique Identification Code, saying that it harms the individual’s Right to Privacy.

History of Right To Privacy

Right to Privacy is not a new concept. It has been debated in India for as long as 60 years in India. The question which arose in the case of Maneka Gandhi v. Union of India has been talked over the years. But all the judgments regarding the right to privacy had been conflicting.

In 2015 the question arose as to whether the Aadhar framework is Unconstitutional, regarding the right to privacy, there was a three-judge bench which decided on this case. Although the Attorney General cleared that the right to privacy is a fundamental right under part III of the Constitution but later in the case of MP Sharma an 8 Judge bench gave judgment that Right to Privacy is not exclusively protected by the Constitution.

Thereafter, the five-judge bench referred to the constitutional question to an even larger bench of nine judges to pronounce authoritatively on the status of the right to privacy.

Right to Privacy Whether a Fundamental Right or Not

On 24th August 2017, a nine-judge bench of the Supreme Court in Justice K.S. Puttaswamy vs Union of India passed a historic judgment affirming the constitutional right to privacy. It declared privacy to be an integral component of Part III of the Constitution of

India, which lays down our fundamental rights, ranging from rights relating to equality (Articles 14 to 18); freedom of speech and expression (Article 19(1)(a)) freedom of movement (Article 19(1)(d)); protection of life and personal liberty (Article 21) and others. These fundamental rights cannot be given or taken away by law, and all laws and executive actions must abide by them.

Retired judge justice K.S Puttaswamy filed a petition challenging the constitutional validity of this Aadhar project contending that there was a violation of the right to privacy of the citizens since, the registration for Aadhar is made mandatory.

As a result of which all those who don’t even want to register themselves, are not left with an option. Moreover, there is a lack of data protection laws in India and hence, there are chances that the private information of the people may be leaked if proper care is not taken. This will lead to a violation of the right to privacy of the individuals.

How Right to Privacy Works

Right to Privacy of an individual extent as long as their privacy doesn’t affect the public at large. Before the rights included in Article 21 of the Constitution, maintaining social order and justice is the primary objective of the law. Fundamental rights cannot be granted, setting aside the norms set for maintaining social order. In Govind v. State of M.P 1975 SCC 148; the Court laid down the following observation

  1. The court cannot completely rely on a right which is not expressly granted by the Constitution. If the Court did so then it would compel the citizens to question the judicial reliability.
  2. Right to privacy cannot be an absolute right and it has to comply with the “state interest test”.
  3. Surveillance cannot be said to be violating the right to life and also right to privacy because only those criminals who are suspected of committing a crime are put under surveillance. This step is necessary to prevent the commission of further crimes.

Why Right to Privacy is Important

Now it is in the Constitution that Right to Privacy is a fundamental right. The judgment of the Supreme Court is correct in all its sense which says that with the growing information technology, privacy needs to be a fundamental right. And if there arises a conflict between infringement of privacy rights and public interest, reasonable care should be taken to see what holds more Importance. After all individual interest cannot override public interest.

The Insolvency and Bankruptcy Code (the BCI) was enacted in order to promote the maximization of the value of assets in a time-bound manner. This code works towards effective protection and to put to Justice, the creditors against the unscrupulous debtors who may misuse the reason for insolvent in order to run away from their liabilities.

Under this code, the National Company Law Tribunal was enacted whereby the conductive and efficacious implementation of the IBC is being carried out, which has instilled confidence among the creditors for systematic and speedy reform. This remedy under the IBC is also available to the unpaid employees of the debtor which is now a growing concern and is being recognized by the judiciary as well.

The National Company Law Tribunal has in their recent case under IBC admitted a case of non-payment to the employees. As of the provisions of the IBC, employees are now considered as the operational creditors in respect of their pending salaries which would be considered as dues on the account of the employer.

1. Employees to be Considered as Operational Creditors


Previously if a company went bankrupt, the employees were left jobless with dues in their salary. But since the IBC was enacted, it gave the employees a chance to get paid off their unpaid hours and hard work in the company.

2. Speedy Trials for the Employees


Again previously the employees suffered years for their trials to come to conclusions and to get paid of their salaries. Some times the proceedings are stretched as long as 10-15 years, in which case most of the employees are already dead before the case came to a decision.

Hence under the IBC, the employees are now provided with rights for speedy trials. The employees of a number of companies including Zeal Global projects, Applied Electromagnetics Pvt. Ltd. and Phadnis Properties have initiated recovery proceedings under the IBC. A time limit of 180 days is been provided to come to a resolution which helps in early proceedings and conclusion which in turn restores the faith among employees in Justice.

With the advent of the IBC, there has been a shift in how employees feel about their jobs. Previously the employees used to be constantly scared of being terminated and thrown out of jobs with or without the reason of insolvency. Should Prisoners be given the Right to Vote?

Right to vote is a right which is given to all the citizens of the country. In India, this right is given to every person above the age of 18. But prisoners are left out of this right, why?

Recently three law students from Uttar Pradesh filed a petition challenging the constitutional validity of section 62(5) of The Representation of the People Act, 1951, which says prisoners, i.e., neither convicts nor undertrials, should be allowed to vote, “if he is confined in a prison, whether under a sentence of imprisonment or transportation or otherwise, or is in the lawful custody of the police.” It argued that a blanket ban on prisoners’ right to vote “is a violation of the spirit and soul of the constitution as well as the basic principle of equality.

Delhi High Court sought the stand of the election commission on this topic. Over 400,000 people of India are housed in the jails across India, and there is no right to vote to this massive population.

Why No Right to Vote for Prisoners?

Law is the set of rules and regulations, bind according to the norms of the society and the people who don’t abide by these norms are convicted as criminals. Criminals are sought as a danger to society and hence are kept away from society. They are confined with barely any enjoyment of life in order to reintegrate them into civilized people of the society. They are given the right to education and are provided with types of entertainment like radio and CD players.

In India 33 out of every 100,000 people are criminals according to the Institute for Criminal Policy Research data which is way lesser than other countries. For example, there are 666 people out of every 100,000 people criminals in the USA. Compared to the six big countries in the South Asian Association for Regional Cooperation (SAARC), too, we have the least number of people in prison per 100,000 population.

But the right to vote is a civil right and denying a civil right is justifiable or not is the question? Denying the prisoners the right to vote is to undermine them of their civil right. It is true that the right to vote is not exactly on the top of the list of people who are not in the prison, and the same way, it won’t be for the people who are in prison.  

The Indian justice system lacks where Article 21 of the Constitution of India clearly states for Speedy trials, the two third of the population of the criminal is under trial. Under which over 40% of the population is detained for six months and 25% for over a year only. People who have committed petty crimes are also denied the right to vote apart from the criminals who have committed heinous crimes like murder and sexual assault.

Why Prisoners should be given the Right to Vote

First of all, there is no difference between the people who have committed petty crimes and those who have committed heinous crimes. All of them altogether are denied the right to vote under section 62(5) of The Representation of the People Act, 1951. Hence people with even the most minor transgression are denied with this franchise.

Criminals of all categories i.e Convicts, Under trials and those who are in custody, are altogether considered as prisoners and are denied the right to vote.

Prisoners are denied to choose and elect the People who govern the criminal justice system and regulate the laws of the prison. While these changes in the laws governing the prison and the criminal justice system directly affect the prisoners.

It is also important to argue that when a person convicted is not denied of their citizenship, why should they be denied of their right to vote?. And lastly, if a criminal can contest in the election, why should they be not allowed to vote?

In the November 2018 election of USA, Florida favoured the right to vote to the incarcerated except serious felonies like sexual assault and murders. Countries like Europe, Switzerland, Finland, Norway, Denmark, Ireland, the Baltic States, and Spain also support the right to vote to prisoners.

Hence there needs to be a change in the Indian Criminal Justice system where at least felonies below conviction of five years should be allowed to vote, upholding the essence of democracy in the Indian constitution.
